Summary

In this trial, Novar Ismailyan was killed after being struck by a car driven by Mira Gjura. The accident occurred at night, as she was crossing a crosswalk. Ismailyan's family sues the city of Glendale, California, arguing that the lack of road striping or flashing lights caused Ismailyan's death. Glendale asserts that Gjura's speeding caused the accident, as Gjura was speeding at approximately 50 miles per hour.

Attorneys for the plaintiff assert that, even if the car was traveling at the posted speed limit of 40 miles per hour in the zone, the accident would have still likely been fatal. Additionally, they claim that the lack of lights or striping to provide drivers with a warning of a crosswalk, especially at night, played a major role in causing the accident.

Representatives for the defense focused on the number of vehicles that crossed the intersection every year without an accident, as well as noting the numerous similarly unmarked crosswalks in the area. They claim that Gjura could have stopped if she were driving the speed limit.
