The pharmacies argue that there is no evidence the retailers colluded to push drugs into the market. Counsel for the companies claim that the hospitals need to prove that the pharmacies acted as criminal drug dealers, and that there were policies for pharmacists to alert when illegitimate prescriptions were suspected.
