Plaintiffs, an injured bicyclist and her husband, filed suit against defendant municipality and a security company, seeking damages for injuries the cyclist suffered when struck by a subdivision's security gate arm. Defendant municipality contends that sufficient warnings were in place to notify the cyclist not to use the entry protected by the arm and it was never notified that the arm was malfunctioning.
Defendant security company, tasked with staffing the gateway, contends that sufficient warnings were in place and that the arm operated as intended. .
Verdict for the plaintiffs.
