Summary

Plaintiffs, an injured bicyclist and her husband, filed suit against defendant municipality and a security company, seeking damages for injuries the cyclist suffered when struck by a subdivision's security gate arm. Plaintiffs contend there were insufficient warnings against cyclists using the entry protected by the gate arm and that the gate arm should not have triggered and raised when the cyclist approached.

Defendant municipality contends that sufficient warnings were in place to notify the cyclist not to use the entry protected by the arm and it was never notified that the arm was malfunctioning.

Defendant security company, tasked with staffing the gateway, contends that sufficient warnings were in place and that the arm operated as intended. .
