Summary
This matter involves an attempt to execute a judgment obtained by LVNV Funding, LLC in the Court of Common Pleas in and for New Castle County on February 4, 2003, and transferred to the Superior Court on April 6, 2004. LVNV made no attempt to execute on the judgment for more than five years after obtaining the judgment, when sometime in September 2012, LVN filed a Motion to Allow Execution on the Judgment, as opposed to revive or refresh the judgment. On October 12, 2012, after Ms. Knott filed her Answer to LVNV's Motion and LVNV filed its Reply, the trial court conducted a hearing. On December 24, 2012, the trial court issued a Commissioner's Report and Recommendation in favor of LVNV and against Ms. Knott.
Outcome
The judgment of the Superior Court was affirmed.
