Peggy and Joseph "JR" Mills were riding their Harley-Davidson motorcycle when they collided with an orange safety drum allegedly owned by Superior Traffic Services. Joseph and Peggy sue, claiming that the companys failure to secure the drum led to the Mills' accident and subsequent injuries.
Attorneys for the plaintiffs argue that STS failed to adhere to regulations, as they did not store the safety barrels more than 30 feet away from lanes of travel during a pause in construction. They frame this failure to secure the barrel appropriately as "cutting corners," leading to JR allegedly suffering a broken scapula and Peggy suffering back injuries and brain damage.
Representatives for the defendants assert that STS complied with safety requirements, completing the NDOT's required four safety inspections per day. The company also argues that it contracted with a third-party company, Fisher Sand & Gravel Co., to oversee the site's safety plan.
