Summary

In this oral argument before the Delaware Supreme Court, the attorney representing plaintiffs, Anthony J. Hunt, a minor, and Hunt's mother, Lisa C. Desombre, appealed the Kent County Superior Court's decision granting the motion for summary judgment filed by The State of Delaware, Trooper Pritchett and other defendants. Trooper Pritchett, who had no training and little experience in interrogating elementary school students, interrogated the eight-year old plaintiff about a bullying incident. On January 28, 2010, the plaintiffs filed action for civil rights violations and state tort claims of intentional infliction of emotional distress; false imprisonment and false arrest; and battery against the defendants based on the theory of respondeat superior, as it relates to Trooper Pritchett's wrongful conduct.

Outcome

The Superior Court's judgment was affirmed in part and reversed in part. This matter was remanded to the Superior Court for further
action.  Jurisdiction was not retained.
