Dingess, et al. v. Hasan, et al.

VERDICT

Trial
11/03/25 – 11/07/25

Summary

A child suffered a traumatic brain injury after being struck by a tow truck while riding a bicycle. The child sues the tow truck company, claiming that the driver was responsible for the accident.

Keith Mitnik, representing the child, claims that driver Zartavius Hasan was driving dangerously fast while in a residential neighborhood. Had Hasan been more careful, he would have been able to brake in time and prevent the child from suffering a severe traumatic brain injury that could require lifelong care.

Glenn Tornillo, representing Hasan, argues that the child's mother failed to provide adequate supervision. While Hasan drove within the posted speed limit, the child suddenly ran into the street, giving him no chance to slow down before impact. Additionally, Tornillo asserts that the injury is serious, but that the child will likely make a significant recovery.
