In this insurance coverage litigation proceeding, plaintiff Linda L Bosetti alleged United States Life Insurance Company in The City of New York of terminating her disability policy payments abruptly after two years and failing to take adequate steps to determine if she could in fact return to work. The plaintiff was an employee of the Palos Verdes Peninsula Unified School District until 2003, when she activated her disability policy citing that fibromyalgia, lower back pain, depression and fatigue made her unable to work. Ms. Bosetti claimed that the insurer terminated her payments after two years citing a limit on coverage for mental and nervous conditions and anticipating her ability to return to work. The defendant claimed that Ms. Bosetti's claims of continued disability involved "subjective" symptoms that couldn't be verified by objective medical evidence.
