In this tobacco trial, plaintiff Jennifer Bagnell, representing decedent Mark Bagnell, sues Philip Morris. Ms. Bagnell claims decades of smoking Philip Morris Marlboro cigarettes caused Mr. Bagnells esophageal cancer, as he began in the 1960s, and did not quit smoking until 2013, six years before his cancer diagnosis.
Defendant Philip Morris alleges that Mr. Bagnells other risk factors for esophageal cancer, such as his alcohol consumption, cigars, and smokeless tobacco use, were to blame. And, as Mr. Bagnell quit Marlboros long before his cancer diagnosis, representatives for the defense claim that other factors were much more likely to be the cause than his cigarettes.
